Al aceptar los presentes términos y condiciones acepta que ha tenido la ayuda de un traductor al idioma inglés o bien que entiende totalmente el idioma inglés y comprende el alcance de los términos aquí descritos.

En nuestras Apps se muestran comandos e instrucciones en idioma español únicamente como cortesía para facilitar su lectura, pero TRUCK4CROSS y DRIVE4CROSS y/o Mugrey LLC NO se hacen responsables si el usuario no comprende el idioma inglés para entender los presentes términos y condiciones.

Legal advice in Spanish(translation): if you do NOT understand or hold capacity to understand the English language, you can NOT accept the terms and conditions nor use the TRUCK4CROSS OR DRIVE4CROSS Apps unless you get help from a translator that helps you understand these terms and conditions

The same time you accept the terms and conditions you accept that you had been helped by a translator or that you understand in full the English language and that you understand in full the writing of the terms and conditions.

In our Apps, instructions are showed translated to Spanish only as a courtesy to facilitate its reading but TRUCK4CROSS, DRIVE4CROSS and/or Mugrey LLC are not responsible if the user do NOT understand the terms and conditions listed below.

CONTRACTUAL RELATIONSHIP

All our Apps users, customers, freight companies, importers and exporters, and any user and/or customer and/or their employees that uses and/or require a service provided by Truck4Cross and/or Drive4Cross Mobile Apps agree that Truck4cross and/or Drive4Cross and/or Mugrey LLC are a marketing and sales agency only.

All our Apps users, customers, freight companies, importers and exporters, and any user and/or their employees that uses Truck4Cross and Drive4Cross Mobile Apps knowledge that Mugrey LLC is a San Diego, California, United States of America, based company.

All users, customers, freight companies, importers, exporters, any user and/or their employees, knowledge that Truck4Cross and Drive4Cross are Mobile Apps that provide the service of localize an available trucking Company with a truck ready to hire for their private service.

All users, importers, exporters, any user and/or their employees, knowledge that all the Trucking Companies listed in Truck4Cross and Drive4Cross Mobile Apps are independent and have no relationship with Truck4Cross and Drive4Cross other than be listed in Truck4Cross and Drive4Cross Apps as independent service providers willing to offer their independent service to Truck4Cross App users and customers. Truck4Cros and/or Drive4Cross and/or Mugrey LLC are not freight Companies.  We only offer the service of localize an available trucking Company that can make the service that the App User is looking for.

All arrangements of the freight service are made between the freight company and the importer and/or exporter. Truck4Cross and Drive4Cross App just provides the information of availability of trucks.

All users, importers, exporters, any user and/or their employees, knowledges and agree that Truck4Cross and/or Drive4Cross do not offer and/or give any service of freight, cargo custody, warehousing, customs paperwork reviews, load and unload of the merchandise, count and/or make inspection of any kind of any merchandise, we do not offer the service of surveillance, supervision, managing or legal advises related with freight services, loads and unloads of any kind. Truck4Cross and/or Drive4Cross does not give any customs advises or retain for custody any document of the Importers, exporters and/or freight companies listed in our App.

All users, importers, exporters, any user and/or their employees, knowledges and agree that Truck4Cross and/or Drive4Cross will not be directly or indirectly be involved in the freight service. We do not have nor seek to contact any importer, exporter, truck driver, customs broker and/or their employees for other business but the one offered in our App

All users, importers, exporters, any user and/or their employees, knowledges and agree that Truck4Cross and Drive4Cross Apps offer as complementary service GPS location of the hired truck, but we are not responsible for surveillance and/or the functioning or malfunctioning of the GPS feature

Truck4Cross and/or Drive4Cross and/or Mugrey LLC do not verify the veracity of the information provided by the Trucking Companies and/or our customers to our Truck4Cross or Drive4Cross Mobile App data base.

All the information provided in our Apps and our website in Spanish is provided as a courtesy translation only.

CONDITIONS OF USE OF TRUCK4CROSS OR DRIVE4TRUCK MOBILE APPS

All users, importers, exporters, any user and/or their employees, agree that:

1. They have read, understood, and agreed to the conditions of use and the contractual relationship.

1. The importers are responsible of the veracity of the information provided to the freight company of their election and/or to their customs brokers. The importers are responsible to provide to the Freight Company hired, the proper legal documents to fulfill the service. We never get involved in supply, file or review any document.

1. Each Freight Company is responsible of the veracity of the information provided to Truck4Cross and/or Drive4Cross Mobile App data base and subsequently provided to the Importers and/or exporters and/or their customs brokers. (Truck4cross and/or Drive4Cross does not verify the information of the trucks and drivers)

1. Truck4Cross and/or Drive4Cross do not offer nor provide, review and/or make any inspection of any kind of any truck, legal or non-legal document, driver’s license, truck’s license, cargo weight, cargo count, cargo inspection, document accuracy filling, etc.

1. The contract and/or agreement and supervision of the freight service is exclusively between the freight company and the importer and/or exporter. Our service is just to help an importer to localize an available truck for the service of their needs.

1. TRUCK4CROSS and/or DRIVE4CROSS services are limited to localize a Trucking company that has an available truck to hire for their private use. Importers are responsible to choose the truck that fulfill their needs of merchandise transportation.

1. GPS service in TRUCK4CROSS and/or DRIVE4CROSS Apps are provided as complementary service, we could refuse the use or shut down the GPS service of our Apps at any time. Truck4Cross and/or Drive4Cross does not make or offer any surveillance of any kind or localizes any truck during or after the service.

1. TRUCK4CROSS and DRIVE4CROSS are not responsible of the election of the route the truck that was hired chooses, we never get involved in the logistics of the freight company nor supervise any service. Our service is only to help an importer and/or an exporter to localize the freight company that has a unit ready to be hired at the customer’s best convenience.

1. TRUCK4CROSS and DRIVE4CROSS use Spanish translation for some commands in our APPS. The Spanish translations are provided only as courtesy to the user. All Terms and conditions of use must be understood, agreed, and accepted as they are written in English language. TRUCK4CROSS and/or DRIVE4CROSS are a US based company.

USER ACCOUNTS

As a user of our website, you may be asked to register with us end provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identity and your log in information. You are also responsible for all activities that occur under, with, and/or your account and/or password.

If you think there are any possible issues regarding the security of your account on the TRUCK4CROSS website and/or TRUCK4CROSS and/or DRIVE4CROSS Apps, inform us immediately by sending an e-mail using our TRUCK4CROSS website or by texting to the phone number 619-520-5772 so we may address them accordingly. We reserve all rights to terminate accounts, edit or remove content and cancel orders at our sole discretion

AGE RESTRICTION

You must be at least 18 (eighteen) years of age before you can use TRUCK4CROSS and/or DRIVE4CROSS Apps. By using these Apps, you warrant that you are at least 18years of age and you may legally adhere to this Agreement.

TRUCK4CROSS and/or DRIVE4CROSS Apps assume no responsibility for liabilities related to age misrepresentation.

INTELLECTUAL PROPERTY

You agree that all materials, products, and services provided on this App are the property of TRUCK4CROSS, DRIVE4CROSS, Mugrey LLC, its affiliates, directors, officers, employees, agents, suppliers, or licensors including all copyrights trade secrets, trademarks, patents, and other intellectual property.

You also agree that you will not reproduce or redistribute TRUCK4CROSS’s and/or DRIVE4CROSS’s and/or Mugrey LLC intellectual property at any way, including electronic digital or new trademark registrations.

You grant TRUCK4CROSS and/or DRIVE4CROSS a royalty-free and non-exclusive license to display, use, copy, transmit, and broadcast the content you upload, give us on any mean and/or publish in our App and/or our website.

For issues regarding intellectual property claims you should contact the company in order to come to an agreement.

APPLICABLE LAW

By visiting TRUCK4CROSS and/or DRIVE4CROSS Apps and/or TRUCK4CROSS website, you agree that the laws of the City of San Diego and/or the State of California, without regard to principles of conflict laws, will govern these terms and conditions or any dispute of any sort that might come between TRUCK4CROSS, DRIVE4CROSS, Mugrey LLC and you, or its business partners and associates.

DISPUTES

Any dispute related in any way to your visit to our Apps and/or website or to products you purchase from us using our TRUCK4CROSS and/or DRIVE4CROSS Apps shall be arbitrated by state or federal court in San Diego, California and you consent to exclusive jurisdiction and venue of such courts.

INDEMNIFICATION

You agree to indemnify TRUCK4CROSS and/or DRIVE4CROSS and/or Mugrey LLC and its affiliates and hold TRUCK4CROSS and/or DRIVE4CROSS and/or Mugrey LLC harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.

LIMITATION ON LIABILITY

TRUCK4CROSS and DRIVE4CROSS are not liable for any damages that may occur to you, your employees, your drivers, your cargo and/or your trucks because of your use or misuse of our App.

TRUCK4CROSS and DRIVE4CROSS are not liable for any loss of merchandise, miscounts, mistakes in load or unload, mistakes in customs advising, mistakes in customs procedures, customs seizures of any kind, extra charges that the freight company incurs during the service, stolen cargo of any nature, delays, traffic accidents, stolen trucks, loss or stolen documents of any kind, etc.

TRUCK4CROSS and/or DRIVE4CROSS do not get in touch or have any contact with neither the cargo, nor the driver or the truck at any time during or after the service.

TRUCK4CROSS and/or DRIVE4CROSS ONLY limited liability is to return to the user the monies effectively paid by the user for a specific service if the truck hired for that service did not provide the freight service because of the freight company’s fault. TRUCK4CROSS and DRIVE4CROSS commissions are not refundable.

TRUCK4CROSS and DRIVE4CROSS reserve the right to edit, modify, and change this Agreement, terms, conditions, and policies at any time.

These terms, conditions, and agreements, are an understanding between TRUCK4CROSS, DRIVE4CROSS, MUGREY LLC, freight companies, and the user, and this supersedes and replaces all prior agreements regarding the use of this App.

PAYMENTS

TRUCK4CROSS will collect thru our App the freight service charges plus the TRUCK4CROSS commissions from the customer and will pay its monies to the freight company that fulfill the service once the customer notify that the load was delivered at the destiny both parties agreed upon. TRUCK4CROSS commissions are not refundable.
